Prosecutors seek new indictment against Hunter Biden

Prosecutors in the office of Special Counsel David Weiss announced Wednesday they plan to seek a grand jury indictment against Hunter Biden, the President’s son, related to a gun possession case.

Attorney General Merrick Garland appointed Weiss, a career prosecutor and U.S. Attorney for the District of Delaware, as special counsel in Hunter Biden’s case last month. Weiss began investigating Hunter Biden in 2019 during the Trump Administration and has remained on the case amid his father’s Administration.

In July, an agreed-to guilty plea by Biden was put on hold related to the gun possession charges—Biden had apparently lied on his purchase application about his struggles with drug addiction—as well as tax evasion charges. The plea deal between federal prosecutors and Biden had hit a snag in federal court in Delaware when U.S. District Judge Maryellen Noreika raised questions about its broader implications regarding prosecutors’ ongoing investigation.

Republicans who’ve been holding their own investigations against Hunter Biden slammed the announced indictment, House Oversight Committee Chair James Comer (R-KY) saying the gun charge is the “least of all the crimes” that Biden has committed.

“They already tried to sneak something through once. We need to make sure that they don’t do it again,” Comer said during a radio interview Wednesday.

Weiss’ office said it expects an indictment before September 29. Hunter Biden’s lawyers have countered that prosecutors are barred from filing additional charges under an agreement the two sides previously reached in the gun case, which contains an immunity clause against federal prosecutions for some other potential crimes. Biden attorney Abbe Lowell said his client has kept to his side of that deal, including making regular probation office visits. 

Lowell said in a statement, “We expect a fair resolution of the sprawling, 5-year investigation into Mr. Biden that was based on the evidence and the law, not outside political pressure, and we’ll do what is necessary on behalf of Mr. Biden to achieve that.”
