Former President Trump on Tuesday asked a federal court in Florida to order the DOJ to provide him and his lawyers with an unredacted version of the affidavit the FBI used to obtain a search warrant at his Florida country club residence Mar-a-Lago in August.
The motion to unseal the affidavit was requested in a court filing in the U.S. District Court for the Southern District of Florida. It was made before U.S. District Judge Aileen Cannon, the same judge who appointed a so-called special master to review the 11,000 documents seized by the FBI during the search.
Prosecutors are conducting a criminal probe over Trump’s retention of government records at Mar-a-Lago after his Presidency ended. The DOJ is also examining whether Trump tried to obstruct the criminal investigation.
On Friday, Attorney General Merrick Garland appointed veteran career prosecutor Jack Smith as special counsel to determine whether criminal charges should be filed against Trump in this case and/or in Trump’s involvement in the January 6, 2021 insurrection on the U.S. Capitol.
