A hearing was scheduled for Wednesday for two Trump co-defendants—attorneys Kenneth Chesebro and Sydney Powell—who want their racketeering cases severed from the former President and others.
Chesebro and Powell are among 19 co-defendants, including Trump, who were indicted by a grand jury last week related to attempts to overturn Georgia’s 2020 election, following a more than two-year investigation by Fulton County District Attorney Fani Willis.
All 19 are charged with racketeering. Chesebro, who co-authored the fake electors scheme, is also charged with conspiring to impersonate a public officer, conspiring to file a false document, and two counts each of conspiring to commit forgery in the first degree and conspiring to commit false statements and writings.
Powell was charged with six additional counts, including conspiring to commit election fraud, conspiring to commit computer theft, conspiring to commit computer trespass, conspiring to commit computer invasion of privacy and conspiring to defraud the state.
Both Chesebro and Powell are seeking a speedy trial, and Chesebro has already had his trial set for October 23.
By contrast, Trump’s attorneys have also filed to sever their clients case, arguing that they “will not have sufficient time to prepare President Trump’s case for trial by the October 23, 2023.”
Willis had hoped to try all 19 racketeering co-defendants at the same time.
Fulton County Superior Judge Scott McAfee will preside over Wednesday’s hearing and weigh both sides’ argument for and against severed trials.
The hearing, set for 1pm ET Wednesday, was expected to be live-streamed.
